Judicial Panel Concurs to Rehear Case

The federal appeals court ruled on Tuesday that it would rehear the case concerning the president’s authority with an larger panel of 11 judges. The court also vacated a previous ruling from a three-judge panel that had supported the administration.

Legal Saga Over Troop Deployment

This order represents the latest turn in a protracted court case over whether the former president has the authority and valid reason to deploy state military units in the city. Approximately two hundred troops have been in limbo since the end of September when the deployment effort was initiated in response to months of protests.

Differing Viewpoints

The administration has argued that government employees at the immigration center in the southern part of the city were facing threats, while city and state officials assert that local officers have command of the circumstances.

Recent Legal Actions

The appeals court decision came after a federal judge in the city issued two temporary restraining orders this month – one blocking the federal control of the Oregon national guard, and another stopping the deployment of any military personnel in Oregon, after attempts to circumvent the first order by calling up troops from California.

On the previous day, the appeals court had put the first ruling on hold – permitting control of state troops – but the subsequent injunction remained in place, blocking the physical sending of the forces.

Full Panel Consideration

The Tuesday decision means the issue will be heard by the full court – with all decisions under review together – by a group of 11 judges.

“This decision shows that facts are important and that the judicial system are striving to hold this administration accountable. The constitution limits the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the state attorney general in a statement.

“The court is sending a clear message: the executive leader cannot dispatch the armed forces into American urban areas without cause. We will continue defending state legislation, values, and sovereignty as this case progresses and our legal battle continues in the judicial system.”
